These Terms & Conditions (“Terms”) govern your access to and use of the PlumbConnect TrundHub26 website, mobile application, platform, and related services (collectively, the “Platform”).

1. OUR SERVICES

PlumbConnect TrundHub26 is a technology platform designed to connect customers seeking plumbing and related home services (“Customers”) with independent plumbing professionals, contractors, or plumbing businesses (“Service Providers”).

Unless expressly stated otherwise, PlumbConnect is not the plumbing contractor performing the work.

Service Providers may operate as independent businesses or contractors and may be responsible for obtaining their own licenses, permits, insurance, tools, employees, and equipment as required by applicable law.

2. ELIGIBILITY

You must be at least 18 years old, or the age of legal majority applicable to you, to use the Platform or enter into a service agreement through the Platform.

By using PlumbConnect, you represent that:

• You have legal capacity to enter into these Terms.
• Information you provide is accurate and complete.
• You will comply with applicable federal, state, and local laws.
• You will use the Platform only for lawful purposes.

3. CUSTOMER ACCOUNTS

Certain features may require you to create an account.

You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.

You agree to notify PlumbConnect promptly if you believe your account has been compromised or accessed without authorization.

We may suspend or terminate accounts that violate these Terms or applicable law.

4. SERVICE REQUESTS AND BOOKINGS

Customers may submit requests describing plumbing or home-service needs.

Submitting a request does not guarantee that a Service Provider will accept the request or that services will be available at a particular time.

Once a Customer and Service Provider agree to perform services, the Customer and Service Provider may enter into a separate service relationship.

Customers are responsible for providing accurate information concerning:

• The service location;
• The plumbing problem;
• Property access;
• Known hazards;
• Required timing; and
• Other information reasonably necessary to perform the requested service.

5. SERVICE PROVIDERS

Service Providers are independent businesses or contractors unless expressly stated otherwise.

Service Providers are responsible for:

• Maintaining all licenses and permits required by applicable law;
• Maintaining legally required insurance;
• Performing work in compliance with applicable building, plumbing, safety, and other codes;
• Providing accurate information about their qualifications;
• Performing authorized work professionally;
• Providing estimates or invoices when applicable;
• Complying with applicable federal, state, and local laws; and
• Addressing claims relating to their workmanship.

PlumbConnect may conduct certain verification or screening procedures. However, verification does not constitute a guarantee that a Service Provider is qualified, licensed, insured, suitable, or capable of performing a particular job.

6. ESTIMATES AND PRICING

Prices and estimates may be provided by Service Providers or through the Platform.

An estimate may change if additional work, materials, labor, permits, code requirements, concealed conditions, or other circumstances are discovered.

Customers should review and approve additional charges before additional non-emergency work is performed whenever reasonably possible and as required by applicable law.

Customers are responsible for paying authorized charges for services and materials.

7. PAYMENTS

PlumbConnect may use third-party payment processors to process payments.

By providing payment information, you authorize applicable charges to be processed using your selected payment method.

You agree not to use fraudulent, unauthorized, or otherwise invalid payment information.

Payment disputes should be reported promptly to PlumbConnect and/or the applicable Service Provider.

PlumbConnect may suspend accounts or restrict transactions where reasonably necessary to investigate suspected fraud, unauthorized payments, chargebacks, or violations of these Terms.

8. CANCELLATIONS AND RESCHEDULING

Customers may cancel or reschedule appointments subject to the applicable cancellation policy disclosed at the time of booking.

A cancellation, dispatch, diagnostic, or other fee may apply where properly disclosed before the service.

Service Providers may also cancel or reschedule appointments when reasonably necessary.

PlumbConnect is not responsible for cancellations or delays caused by circumstances outside its reasonable control.

9. EMERGENCY SERVICES

PlumbConnect does not guarantee emergency response times.

If you have an immediate emergency involving fire, gas, electrical hazards, flooding that presents an immediate danger, structural danger, injury, or another threat to life or safety, contact the appropriate emergency service, utility company, or qualified emergency professional immediately.

Do not rely solely on PlumbConnect for emergency assistance.

10. SERVICE QUALITY AND WARRANTIES

PlumbConnect generally provides a technology and marketplace platform and does not itself perform plumbing services.

The Service Provider is responsible for the quality, safety, legality, and completion of services it performs.

Any workmanship warranty, guarantee, or service warranty is provided by the applicable Service Provider unless PlumbConnect expressly provides a separate written warranty.

Customers should contact the applicable Service Provider regarding workmanship disputes, warranty claims, damage, or incomplete work.

11. PROPERTY ACCESS

Customers must provide reasonable and lawful access to the property when necessary to perform authorized services.

Customers must inform Service Providers of known hazards, access restrictions, pets, security requirements, or other conditions that may affect the work.

Customers may not request or encourage unlawful, unsafe, fraudulent, or unauthorized work.

12. PROPERTY DAMAGE

A Service Provider may be responsible for property damage caused by the Service Provider’s negligence, misconduct, or violation of applicable law.

PlumbConnect is not responsible for:

• Pre-existing damage;
• Hidden or concealed defects;
• Normal wear and tear;
• Conditions outside its reasonable control;
• Damage caused by the Customer or another third party; or
• Damage unrelated to PlumbConnect’s own conduct.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

13. CUSTOMER REVIEWS

Customers may submit ratings, reviews, photographs, comments, and other feedback.

Reviews must be based on genuine experiences and must not contain fraudulent, threatening, defamatory, discriminatory, or intentionally misleading information.

PlumbConnect may remove content that violates these Terms or applicable law.

14. USER CONTENT

You retain ownership of content you submit to PlumbConnect.

By submitting content, you grant PlumbConnect a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, modify, and publish that content as reasonably necessary to operate, improve, promote, and provide the Platform.

You represent that you have the legal right to submit the content.

15. PROHIBITED ACTIVITIES

You agree not to:

• Use the Platform for unlawful purposes;
• Provide false or misleading information;
• Impersonate another person or business;
• Access another person’s account without authorization;
• Interfere with Platform security or operation;
• Introduce viruses, malware, or harmful code;
• Scrape or copy Platform information without authorization;
• Circumvent legitimate Platform fees;
• Commit fraud;
• Harass, threaten, abuse, or discriminate against another user;
• Request or perform unlawful plumbing or construction work; or
• Use the Platform in a manner that violates applicable federal, state, or local law.

16. INTELLECTUAL PROPERTY

The Platform and its content, including software, designs, graphics, logos, trademarks, text, databases, and other materials, are owned by or licensed to PlumbConnect and are protected by applicable intellectual-property laws.

You may use the Platform only for its intended purpose.

You may not reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit Platform content without written authorization.

17. THIRD-PARTY SERVICES

The Platform may use or integrate with third-party services, including payment processors, mapping services, communications providers, identity-verification providers, analytics services, and other technology providers.

Third-party services may have their own terms and privacy policies.

PlumbConnect is not responsible for the independent actions, policies, availability, or content of third-party services.

18. PRIVACY

Your use of PlumbConnect is also governed by our Privacy Policy, which describes how we collect, use, disclose, and protect personal information.

Additional privacy rights may apply depending on the state in which you reside and the nature of PlumbConnect’s business.

Nothing in these Terms is intended to waive a privacy right that cannot legally be waived.

19. ELECTRONIC COMMUNICATIONS

By using the Platform, you consent to receive electronic communications relating to your account, bookings, transactions, service requests, security, and other operational matters.

Where permitted by law, PlumbConnect may also send promotional communications.

You may opt out of promotional communications through the unsubscribe mechanism provided in the applicable communication.

20. DISCLAIMERS

To the maximum extent permitted by applicable law, the Platform is provided on an “AS IS” and “AS AVAILABLE” basis.

PlumbConnect does not guarantee that:

• The Platform will always be available;
• A Service Provider will accept a request;
• A Service Provider will arrive at a specific time;
• A plumbing problem will be successfully resolved;
• Information on the Platform will always be complete or error-free; or
• A particular Service Provider will meet a Customer’s expectations.

PlumbConnect does not provide legal, engineering, architectural, insurance, or emergency services unless expressly stated otherwise.

21. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, PlumbConnect and its officers, directors, employees, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Platform or services arranged through the Platform.

To the maximum extent permitted by law, PlumbConnect’s total liability arising out of or relating to the Platform will not exceed the greater of:

1. The amount you paid directly to PlumbConnect during the twelve (12) months preceding the event giving rise to the claim; or
2. $100.

These limitations do not apply where prohibited by applicable law.

22. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless PlumbConnect and its officers, directors, employees, affiliates, agents, and service providers from claims, damages, liabilities, losses, costs, and reasonable attorneys’ fees arising from:

• Your violation of these Terms;
• Your misuse of the Platform;
• Your violation of applicable law;
• Your violation of another person’s rights;
• Content you submit; or
• Your dealings with Customers or Service Providers.

23. DISPUTE RESOLUTION

If you have a dispute with PlumbConnect, you agree to first contact us and provide us with a reasonable opportunity to resolve the matter informally.

Where legally permitted, PlumbConnect may require eligible disputes to be resolved through mediation or binding arbitration rather than litigation.

Any arbitration provision, class-action waiver, or similar provision should be reviewed and customized by qualified U.S. legal counsel before being included in the final published Terms.

Nothing in this section prevents a consumer from exercising rights that cannot legally be waived.

24. GOVERNING LAW

These Terms shall be governed by the laws of the State of [STATE], without regard to conflict-of-law principles, except where mandatory federal or state law provides otherwise.

Your continued use of the Platform after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

27. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

28. ENTIRE AGREEMENT

These Terms, together with the PlumbConnect TrundHub26 Privacy Policy and any additional terms incorporated by reference, constitute the agreement between you and PlumbConnect concerning your use of the Platform.
